Overview
These Mobile Messaging Terms of Service (“Mobile Terms”) govern your participation in TacticalUSA’s text messaging program (“Program”). By opting in, you agree to receive recurring SMS/MMS text messages from TacticalUSA to the mobile number you provide.
Important: Consent to receive marketing text messages is not a condition of purchase. Message & data rates may apply. Reply STOP to cancel, HELP for help.

Program Description
The Program may include marketing, promotional, transactional, and informational messages, such as:
- Promotions, discounts, and special offers
- Product launches and announcements
- Order confirmations and receipts
- Shipping and delivery updates
- Account alerts and customer service messages
- Cart reminders and post-purchase follow-ups
- Subscription and billing reminders (if applicable)
Message frequency varies based on your interactions with TacticalUSA and your enrollment preferences.
Consent and TCPA Authorization
By providing your phone number and opting in (for example, by checking an opt-in box, completing a form, sending a keyword, or otherwise affirmatively consenting), you agree and expressly consent to receive recurring automated text messages from TacticalUSA.
You understand and agree that:
- Your consent is an electronic signature and satisfies applicable legal requirements, including the TCPA
- Messages may be sent using an automated system, including an autodialer
- Consent to receive marketing text messages is not required as a condition of purchase
- You are the account holder or authorized user of the mobile number you provided
- You may withdraw consent at any time by following the opt-out instructions below
We may send a confirmation message and/or require additional verification to confirm your opt-in.
How to Opt In
You may opt in through one or more of the following methods:
- Website checkout checkbox consent
- Website forms, pop-ups, landing pages, or account registration
- Texting a keyword to a number we provide
- Other clear, affirmative actions indicating consent
We do not use pre-checked consent boxes for SMS marketing opt-ins.
Opt-Out and Help
You can cancel at any time by replying STOP to any message.
You can get help by replying HELP to any message.
After you reply STOP, you may receive one final confirmation message that you have been unsubscribed. You agree that opt-out requests may take a short time to process, but we will honor them as required by law.

Message and Data Rates
Message and data rates may apply depending on your mobile carrier plan. TacticalUSA does not charge you for messages, but your carrier may.
Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier, network availability, and your device.

We do not sell your phone number to third parties for their marketing purposes. We may share information with service providers who help us operate the Program, subject to appropriate confidentiality and security obligations.
Consent Records
To help demonstrate lawful consent and comply with applicable requirements, we may maintain records associated with your opt-in, such as:
- Date and time of opt-in
- Phone number submitted
- Opt-in method and source page/form
- Consent language presented at opt-in
- IP address and device/browser data (where available)
Eligibility
By participating, you represent that you are at least 18 years old and are located in the United States. You are responsible for providing an accurate and current mobile number.
Prohibited Conduct
By using the Program, you agree not to:
- Enroll a number you do not own or control
- Use automated, fraudulent, or abusive sign-up methods
- Interfere with the Program or attempt to bypass opt-out controls
We may suspend or terminate participation if we reasonably believe there is abuse, fraud, or non-compliance.
Changes to the Program or Terms
We may update these Mobile Terms or modify the Program at any time. Updates will be posted on this page with an updated Effective Date. Your continued participation after changes become effective constitutes acceptance of the updated terms.
Limitation of Liability
To the maximum extent permitted by law, TacticalUSA is not liable for any delays, failures, or errors in message delivery, including those caused by your carrier, third-party service providers, network issues, or device limitations.
Arbitration and Class Action Waiver
READ THIS SECTION CAREFULLY. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to the Program or these Mobile Terms (including any alleged violation of the TCPA or similar laws) will be resolved by binding individual arbitration and not in court, except you may assert claims in small claims court if your claims qualify.
No Class Actions. You and TacticalUSA agree that each may bring claims against the other only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
The arbitration will take place in Collin County, Texas, unless you and TacticalUSA agree otherwise. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve the individual claim.
If any part of this arbitration and class action waiver section is found to be unenforceable, then the remainder will remain in effect to the fullest extent permitted by law.
